Another Wrongful Death Crash in I-71 in Cincinnati

Another wrongful death was reported on 1-71 interstate 71 in Cincinnati. At about 3:30 AM a woman, Anna Gardner was traveling southbound in the northbound lane of interstate  71 and hit a semi tractor trailer truck head on.
Kevin Lane a passenger in the tractor trailer and Kenneth Cripps, the truck driver were transported to Bethesda Hospital with injuries.

It's so sad. And I'm left wondering how this lady was going the wrong way on the interstate. Condolences to everyone involved. There are some entrances that can be confusing if one is not watching carefully.

Legally this is not technically a wrongful death as the lady that died appeared to be at fault for traveling in the wrong direction. In fact this is the opposite of a wrongful death and if settlement can not be made with her insurance company an estate would have to be opened on her behalf.

A wrongful death claim occurs when someone is killed as a result of the fault of another. An estate has to be opened on behalf of the beneficiaries to purse compensation against the one who caused the death.

But in this case the truck driver and the passenger appear to have been negligently injured by the deceased driver. Since the driver is deceased, if the claim can not be settled with her insurance company an estate would have to be opened so the injured parties could have a legal entity to pursue.

Chris Smith Killed Wrongful Death by Hit and Run Driver Call Police

Another reckless Hit and Run Driver has caused an auto accident the killed professional MMA fighter Chris Smith. Early reports from police are that a grey silver motor vehicle attempted to make an illegal pass which caused an oncoming car to swerve left of center of the highway and hit Smith's car in a full frontal crash.

Chris Smith was just starting out his career as an ultimate fighter but his life was cut short by this alleged hit and run driver. Dominique Steele was taken to University Hospital with serious injury, although reportedly not life threatening. There is a search on for the driver that fled the scene.

 Joshua Bach was reported to be the driver of the car that was forced left of center by the hit and run vehicle. He was taken to the hospital for his injuries.

From what can be pieced together from the early reports it appears that the Smith vehicle would have been traveling behind and in the same direction as the "hit and run" car. They had been traveling eastbound. The car crash happened on State Route 73. The car crash and wrongful death happened Thursday April 5th around 6 PM.

The Ohio State Highway Patrol is asking for help. If you have any information please call the Portsmouth Post at 740-353-2888. If the wrongdoer happpens to read this article, you should turn yourself in. What has happened is grave and will change Cris Smith's family forever. However the first step in the healing and forgivenes would be for you to turn yourself in.

West Union Car Crash With Injuries Needs Witnesses

A West Union Ohio woman, Regina Baldwin,  was injured in a car crash. Also injured were Jason Rogers, Christie Day and Katlyn Baker.

Preliminary investigation by the Ohio state highway patrol revealed Regina Baldwin was driving southbound on Moore's road. Jason Rogers was driving westbound on state route 32. The cars crashed at the intersection.

It appears from the photo and the google maps that Moores road is a stop sign controlled street. If this is the case then the driver coming from Moores road crossing Ohio  State Route 32 has a duty to stop and not enter the intesection until it can be done with safety.  There are multiple factors such as speed that can come into play. A determination of responsibility is never simple. As an investigation aide, google maps has been accepted as reliable and is a good investigatory tool for law enforcement and accident reconstructionists.
