Semi-Truck Violates Traffic Control Causes Injury in Cincinnati

Early yesterday a semi tractor-trailer  operator violated a traffic control device and caused serious injury. The unusual truck accident actually occurred in downtown Cincinnati. The truck reportedly made an illegal left hand turn causing a crash with two other vehicles.

A truck driver from Florida, Richard Rutledge was driving his truck. He attempted to make a left hand turn onto Broadway from Third street . This caused a crash with a semi truck operated by Kingsley Ghari. That motor vehicle flipped over and caught fire. This vehicle then struck a third vehicle. the extent of the injuries were not reported.

Commentary:

Violation of a traffic statute is normally negligence. However the insurance company may try to argue that there was also fault on others. This is a common defense they use to attempt to reduce their fault. They as well as any trucking company needs to be called on it.

Trucking companies are known for delay and denial. Sometimes the best practice is  a lawsuit sooner than later. Especially if your injuries are well defined. This does not mean your case will go to trial, but it can serve to get the case favorably resolved.

Cincinnati Injury Lawyer On Fatal Crash Man Baby Killed

A fatal car crash in Butler County, Ohio killed two people . One was 24 year old Mathew Hale and another death was an 11 month old. This happened this past Thursday, July 26, 2012.

Sheriff deputies from Butler County are investigating the auto and pick up truck crash. The police state that
Kathleen York was driving a Chevy Malibu on Keister Road and failed to stop at a stop sign before entering Ohio 4.  She struck the pick up truck driven by Robert Broshear that was traveling south on route 4.

Mathew Hale and a 11 month old , passengers in the York vehicle were killed. There was also a 2 year old injured as well as both drivers.

If you happened to have witnessed the accident please make sure the Butler County Sherriff's office is notified.

Commentary:

Fatal car crashes are so emotional and so life altering. Multiple families will never be the same. Apart from the legal issues , both criminal and civil, the emotional toll on the survivors and next of kin of those killed
can lead to severe emotional illness. Traumatic loss experts can help people put their life back together in time so at least they can function . But life will still never be the same again.


Police say that there have been other crashes at this intersection. The stop signs appear to sit back from the intersection. But it is not known why Kathleen York failed to yield the right away. Although they say she failed to stop, whether the car stopped or not does not change the legal implications.

Car Accident on I-71 in Warren County, Ohio Causes Multiple Injuries

Car truck accident I-71

On I-71 near Lebanon, Ohio there was an early morning multiple motor vehicle collision that caused serious injuries. Five vehicles were involved. Police authorities say Mark King was operating a tractor-trailer semi. He was going north on Interstate 71. The truck driver rear ended a pick up truck driven by Larry Davidson.

That impact shot the pick up forward into a rear end collision with a car driven by Denna Hazeley. That vehicle was pushed into a truck driven by Bill Carroll. That truck then rear ended a car driven by Brian Paul of Batavia.

This car truck collision occurred near mile marker 34 at the Jeremiah Morrow Bridge. This car truck multiple vehicle crash caused multiple severe injuries. Sharon Patterson, a front seat passenger in the auto driven by Denna Hazeley, was care flighted to Miami valley Hospital. A two year old,  also a passenger with them, was care flighted to  Cincinnati Children's hospital.

Commentary

From the description of the car truck crash it sounds as if the semi-tuck driver violated the assured clear distance statute. A violation occurs when a motor vehicle driver strikes a vehicle in front of him, in the same lane of travel, that is visible. R.C. 4511.21 The defense is that it was impossible to comply with the statute. That is why the other vehicles should not be at fault. However multiple vehicle collisions can be fraught with legal and factual issues.Right now I'm involved with a 16 car pileup. 

You can only hope that the police document the scene with a Total Station and take clear photographs. I've seen some great investigative reports and some inadequate ones. Also in the case of a tractor trailer, there can be other issues such as sleep deprived driving as well as insurance coverage issues.  With  multiple vehicles, it is a good idea to check your own insurance policy for sources of compensation.

Cincinnati Auto Crash Pedestian and Two Others Injured

A two vehicle auto crash was reported today by www.Cincinnati.com . The crash occurred at the intersection of Henry and Dunlap. Apparently the stop sign controlling traffic at Henry Street in Cincinnati was missing and a police cruiser and another car entered the intersection at the same time.

The pedestrians apparently were struck due to the movement of the cars after the collision. Police are still investigating. The two drivers and the pedestrian were taken to the hospital.

Commentary

So who is responsible for this accident? I can see every one proclaiming their innocence. The big question is how long had that  stop sign been down and who took it down.

Another Motorcyclist Killed in Cincinnati Car Motorcycle Accident - Please Watch for Motorcycles

It almost seems like there has been an epidemic of motorcyclists being killed by careless car drivers. The latest was Jason Claypool. The person that caused the car accident is alleged to have left the scene. Although Brittony Ison of Delhi was caught after turning herself in.

The car motorcycle accident crash was described in news reports as hitting the back of Jason Claypool's motorcycle on I-75 at I-74. The impact forced Mr Claypool into a guardrail. Once again the news ,as usual, commented that Mr Claypool did not wear a helmet. So what. That just tarnishes the loss of a father of three children and feeds into prejudices against motorcycles.

In Ohio it is perfectly legal if you have been riding for more than a year to not wear a helmet. Certainly not wearing a helmet had nothing to do with this terrible car motorcycle accident. The fact is that this man was doing what he enjoyed and what he had the absolute right to do.

It only takes a careless moment to destroy a life. A motorcyclist can take every precaution in the world and still end up seriously injured or killed because an auto driver did not Watch for Motorcycles or did not Look Twice.

Another Cincinnati Motorcyclist Critically Hurt By Left of Center

Cincinnati Motorcycle Car Crash Critical Injury

A motorcycle rider was seriously injured in Walnut Hills on Monday June 4, 2012. It is reported a car went left of center striking the motorcyclist, Kyle McCann.

Mr McCann was driving a 1999 BMW motorcycle. He was traveling south on Victory Parkway. A car identified as a Chevy Malibu came into the motorcyclists path and lane crashing into him.

Mr McCann was rushed to University hospital. The accident occurred about 9 pm at William Howard Taft and Victory Parkway. The Cincinnati police are still investigating. If you witnessed this please call the Cincinnati police department at 352-2514 traffic investigations.

COMMENTARY

It is critical for witnesses to step up in traffic accidents. Far too often the prejudice against motorcycle riders takes over.But motorcycles have as much right to the road as cars.

 The report on this was minimal. But this could have been a left of center case , a turn from the side into the motorcyclists lane . It's just not clear. Although apparently the motorcyclist was not at fault and the Chevy Malibu was.

Cincinnat Car Bus Accident One Killed Many Injured

It was reported that a car rear ended another car then went left of center crashing into a metro bus. It was reported that Charnisha Hardy was killed in the car bus crash and was the driver of the car that rear ended  another car that was stopped in traffic as she was heading eastbound on North bend road.

Multiple people were injured.  Channel 19 reported the bus driver was seriously injured and hospitalized . Many lives will be forever changed and condolences to everyone injured or killed in this car bus accident.

Commentary

It appears from the police reports that the person that was killed was at fault for violating the assured clear distance statute. When someone dies responsible for a car accident an estate should be opened at some point so the accident injury victims have a legal entity to bring their claims against. There are certain time limits that are applicable.

Also with multiple injuries the question is whether there is enough insurance to go around to compensate for the losses and damages. This brings into play the question of underinsured motorist coverage available to the people injured.

Another legal issue is that the bus driver has two claims. since they were working they can bring a workers compensation claim. In addition the bus driver can bring a claim against the deceased and the insurance coverage she had available.
